TASKS OF THE LOCAL EMERGENCY PLANNING COMMITTEE (LEPC)Following is a summary list of minimum tasks the LEPC must accomplish. ADMINISTRATIVE TASKS1. Assure the LEPC has members to represent the various groups listed in the law and submit the list to the State Emergency Response Commission (SERC) for appointment. 2. Establish bylaws. 3. Appoint a Chair, County Emergency Coordinator, and Information Coordinator. 4. Maintain records of LEPC meetings, expenses, and activities, and report them to the SERC on a quarterly basis. 5. Receive certification from each Extremely Hazardous Substance (EHS) facilities required to develop an Emergency Response Plan that an annual review and exercise of the plan has occurred. 6. Establish a separate non-lapsing account through the County Treasurer’s Office to handle finances to meet the operations and training needs of the LEPC. 7. May commence a civil action against an owner or operator of a facility for failing to provide information under Section 303 (d) or for failing to submit chemical inventory information under Section 312 (e)(1) (Section 326 (a)(2)(B). DATA MANAGEMENT TASKSCreate a system for the storage and retrieval of the Material Safety Data Sheets (MSDS), Chemical inventory, and toxic release reports that facilities are required to submit to the LEPC.EMERGENCY NOTIFICATION TASKSReceive initial verbal emergency release notification and develop a system for recording and tracking this information. Receive written follow-up notifications and develop a system for filing
these PLANNING TASKSDevelop an emergency response plan consisting of hazardous material response procedures based on a hazard analysis of existing potential threats posed by chemicals at fixed sites and being transported into and through the jurisdiction. Research existing resources for hazardous material response and make recommendations for correcting shortfalls. Include procedures for coordinating with other jurisdictions when the vulnerability zone overlaps jurisdictional boundaries. Submit the LEPC emergency response plan to the Maine SERC. Review LEPC plan at least annually and update as required. COMMUNITY RIGHT-TO-KNOW TASKSDevelop written procedures for handling the receipt and processing of
requests for Fulfill requests from the public for emergency release notifications, MSDS’s and inventory forms. Publish annually in local newspapers that the plan, reporting forms, and emergency release follow-up notices are available to the public. Develop a system for making the Emergency Operations Plan and the response procedures available to the public. Hold a public meeting to discuss the plan. Provide information and discussions about hazardous substance emergency planning and health and environmental risks. TRAINING TASKSList training programs within the LEPC district and obtain schedules
for training EXERCISING TASKSDevelop a schedule for exercising the procedures that the LEPC develops and decide what types of exercised will be held. LEPC FUNDINGThe Maine SERC has made provisions for providing funding for LEPC’s. |
